I. General Terms and Conditions
§1 Scope
(1) These Terms and Conditions apply to all contracts concluded between you and us as the seller, Ivonne Budimir, trading as “Little Man Happy”, via the website www.littlemanhappy.com, unless otherwise agreed.
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
A business customer is any natural or legal person or partnership acting in the course of their commercial or independent professional activity.
§2 Conclusion of Contract
(1) The subject of the contract is the sale of goods offered in our online shop.
(2) By placing products on our website, we make a binding offer to conclude a purchase contract under the conditions stated in the product description.
(3) The contract is concluded via the online shopping cart system.
After placing items in the shopping cart and completing the checkout process, you submit a legally binding offer by clicking the “Purchase” button.
(4) You will receive an order confirmation by email. Please ensure that the email address provided is correct and that emails from us are not blocked by spam filters.
§3 Retention of Title
Goods remain our property until full payment has been received.
§4 Warranty
Statutory warranty rights apply.
Customers are requested to inspect delivered goods immediately upon receipt and to report any visible defects or transport damage without delay. This does not affect statutory warranty rights.
§5 Prices, Shipping & Returns
(1) All prices listed are total prices and include statutory taxes. Shipping costs are shown separately during checkout.
(2) Shipping costs depend on the delivery destination and are displayed before the order is completed.
(3) If an order qualifies for free shipping and is later returned, the standard shipping costs may be deducted from the refund.
(4) Return shipping costs are borne by the customer, unless mandatory consumer protection laws provide otherwise.
(5) For deliveries outside the European Union, additional customs duties, taxes, or fees may apply. These costs are determined by local authorities and must be borne by the customer.
Customs duties, taxes, and shipping costs are non-refundable.
§6 Delivery
(1) Delivery times are provided for informational purposes only and may vary depending on destination and external circumstances beyond our control.
(2) Parcels are not transported on weekends or public holidays.
(3) Once an order has been dispatched, changes to the delivery address are no longer possible.
§7 Risk Transfer
For consumers, the risk of accidental loss or deterioration of goods passes to the customer upon delivery.
§8 Governing Law
German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), provided that this does not restrict mandatory consumer protection laws of the customer’s country of residence.
